Will of Elizabeth PICKSTONE (1740-1803)

This is the last Will and Testament of Elizabeth PICKSTONE wife of Joseph PICKSTONE of Guildford in the county of Surrey executed and duly attested. In pursuance by virtue and in exercise of the power and authority reserved to me in and by a certain indenture of three arts bearing the date the thirty first day of December 1788 duly executed. And made between myself by the order and description of Elizabeth BUDD of the Island of Guernsey Spinster of the first part and the said Joseph PICKSTONE of the second part and Mark Gregory and Thomas GREGORY of the City of London Merchants of the third part being a settlement made previous to my marriage with the said Joseph PICKSTONE.

And whereas since my said marriage I have now and do continue to carry on and execute the contract with the Lords Commissioners of his Majesty’s treasury for supplying the garrisons of the Island of Guernsey Jersey and Alderney with provisions and stored for the use of his Majesty’s Land Forces therein pursuant to the contract in the said Indenture mentioned. And from which certain profits have arisen to me and I have thereby realised diverse sums of money for my separate use and benefit. Which sums of Money are particularised and set forth in papers annexed to or kept with this my Last Will and written with my own hand amounting in the whole to the sum of ten thousand two hundred and thirty nine pounds and eleven shillings which sum has by myself been paid at different times into the hands of my said Dear husband as by the papers or accounts alluded to will appear.

Whereas it is my Will And I do hereby give devise and bequeath unto my said husband for and during the term of his natural life all and every profit advantage and interest arising and which may from time to time arise from the said before mentioned sum to be enjoyed by my said husband during he life and at his decease the said principal sum of ten thousand two hundred and thirty nine pounds and eleven shillings to devolve and become the property of my nephew Richard Henry BUDD of Stoke Hill in the said county of Surrey Esquire his heirs executors and assigns.

And whereas in and by a certain other indenture of Settlement also made previous to my marriage with the said Joseph PICKSTONE bearing the date [blank] day of  [blank].  I have the right and power of disposition of a moiety of the sum of seven thousand one hundred thirty two pounds fourteen shillings three per cent consolidated Bank securities standing in the names of the trustees therein mentioned after the decease of my said husband exclusive and independent of him my said husband.

Now I do exercise of the power and authority thereby reserved to me for that purpose give and bequeath the said moiety to my nephew aforesaid Richard Henry BUDD and John Robert BUDD

of Lyme in the county of Dorset Gentleman . In trust nevertheless for the purposes hereinafter mentioned that is to say that my said trustees and the survivor of them his executors and administrators from time to time. And at all times thereafter do and shall pay and apply the same to or permit and suffer Harry DOBREE of the said Island of Guernsey Gentleman and my niece Applegarth DOBREE his wife. To have receive and take the yearly interest dividends and proceeds of the said Moiety of Seven thousand one hundred thirty two pounds four shillings Bank annuities from time to time and at all times. During their joint lives and the life of the survivor of them the said Harry DOBREE and Applegarth his wife then upon trust that my said trustees last mentioned or the survivor of them his executors and administrators do and shall apply and the said trust funds and the stocks funds and securities in or upon which the same shall be invested as well as the produce arising by sale or disposal of the said contracted premises to and amongst all or any one or more of the children of the said Harry DOBREE on the body of the said Applegarth DOBREE begotten or to be begotten equally if more than one equally share and share alike. And if there shall be but one such child  then to such child or children in manner following (that is to say) the part or share of such of them as shall be a son or sons to be paid at his or their age or ages of twenty one years and the part or share of such of them as shall be a daughter or daughters at such age or ages or day or days of marriage and that if any such child or children being a son or sons shall happen to depart this life under the age of twenty one years or being a daughter or daughters shall happen to depart this life under that age  and unmarried then the share of him her or them so dying shall go and be paid to the survivor or survivors of them at such times as his or her original share shall become payable.

And my Will is that all and every share and shares so directed to survive shall from to time survivor together with the original share and shares until such original share and shares shall become payable  and upon this further trust that my said trustees or the survivor of them his executors or administrators shall and do in the mean time after the decease of the survivor

of them the said Harry DOBREE and Applegarth his wife pay and apply all the dividends interest and proceeds of the said trust monies and premises so given and bequeathed to them as aforesaid or a sufficient part thereof for and towards the maintenance and education of such child or children until their respective shares shall become payable in proportion to their respective shares.

And I will and bequeath all and every residue and remainder of my property of whatsoever description whether real or personal to my said nephew Richard Henry BUDD his heirs executors and assigns whom I therefore constitute and appoint my residuary legatee provided nevertheless that he the said Richard Henry BUDD his heirs executors and assigns as aforesaid pay or cause to be paid immediately after my decease the legacies herein after mentioned (that is to say).

To my aforesaid Nephew Jolye Herbert BUDD the sum of one pounds of good and lawful money of these dominions.

And to my aforesaid niece Applegarth DOBREE that he the said Richard Henry BUDD his executors administrators and assigns deliver or cause to be delivered all my wearing apparel of whatever and every description the same may be and likewise that he the said Richard Henry BUDD his executors Administrators and assigns pay to my servant Mary SHERLOCK if living with me at the time of my decease the sum of twenty guineas together with a suit of mourning and further that the said Richard Henry BUDD so cause to be made and provided immediately after my decease twenty mourning rings of the value thirty shillings each such to be distributed one to each of those my relations and acquaintances as my said dearly beloved husband Joseph PICKSTONE and the said Richard Henry BUDD shall think proper.

And lastly I do hereby constitute nominate and appoint my said dear husband Joseph PICKSTONE and my said nephew Richard Henry BUDD executors and trustees of this my last  and only Will and testament written on one sheet of paper and in which there are two interlineations only. In witness whereof I the said Elizabeth PICKSTONE have herein to set my hand and seal this twentieth day of January in the year of our Lord one thousand eight hundred and three. Elizabeth PICKSTONE. Signed sealed published and declared by the said Elizabeth PICKSTONE as and her last Will and Testament in the presence of us who at her request and in presence of each other  have here unto subscribed our names as witness Robert BLOXHAM Sarah BUCKOLL John  BRANSDEN.

This Will was proved at London the 17th day of September in the year of Our Lord 1803 before the Worshipful ? SEWELL Doctor of Laws and Surrogate of the Right Honourable Sir William WYME Knight also Doctor of Laws Master Keeper or Co missionary of the Prerogative Court of Canterbury lawfully constituted by the oath of Richard Henry BUDD the Nephew of the deceased and one of the executors named in the said Will to whom administration was granted f all and singular the goods chattels  and credits of the said deceased limited so far as concerns all her Right Title and interest in and to all sum and sums of money which have during the continuance of her covenant become due and payable from the right Honourable the Lords Commissioners of his Majesty's Treasury under and by virtue of Articles of Agreement  for the supplying the garrisons of the Island of Guernsey and Jersey with certain provisions stores and other things for the use of his Majesty's Land forces in the said islands respectively or any ? contract or agreement or other contract or contracts for the supplying thereof  her the said Elizabeth PICKSTONE formerly BUDD or her nominee has entered into shall or may arise and become due and payable or which she the said Elizabeth PICKSTONE  formerly BUDD Mark Gregory or Thomas GREGORY may have realised or shall realise or may have arisen or shall arise to them or either of them under the said writed agreement or any renewed contract or agreement or other contract or contracts  as aforesaid together with all the Right Title and interest  of her the said Elizabeth PICKSTONE formerly BUDD in the moiety or half part of the sum of seven thousand one hundred and thirty two pounds four shillings three per cent consolidated Bank Annuities  reinvested and the accrued produce of the sum of five thousand pounds like Bank annuities. In trust  to Thomas GREGORY , Lannoy Richard COUSSMAKER and William HAYDON and now standing in their or some of their names in the books of the Governor and Company f the Bank of England  which by virtue of the aforesaid indenture had a right to dispose of and hath disposed of her said will accordingly and all interest hereafter to grow ? thereon and the profits and produce thereof and benefit and advantage to be had received and taken thereon but no further or otherwise or in any other manner whatsoever having been first sworn duly to administer power reserved of making the like grant to Joseph PICKSTONE the lawful husband of the said deceased when he shall apply for the same.
