In the name of God Amen. I Henry BUDD of the parish of St Peters Port in the Island of Guernsey being in perfect health and a disposed mind and memory praised be God for the same . Do make and publish this my last will and testament in writing revoking all former wills and donations in form manner following that is to say first and principally I recommend my soul into the hands of Almighty God who gave it hoping through the Christ's Death also passion of my [elapsed?] Saviour and Redeemer Jesus Christ to obtain full pardon for all my sins and to [inwrit?]. Eternal life my body I commit to the Earth and all such worldly estate where with God hath [elapsed?] me.
I give devise and bequeath the same as follows that is to say in the first place I do appoint my dearly beloved wife Mary daughter of the late Mr John CHITTY of Guildford in the parish of Witley and county of Surrey sole executrix of this my last Will and Testament and bequeath unto her all and the whole of my personal estate and effects whether in this Island of Guernsey or in England. And do hereby empower and enable her to receive and collect for her separate use all such Money or Monies as may happen to be due to me by the Right Honourable the Lords Commissioners of his Majesty's Treasury or by any person or persons whatsoever at the time of my decease. I do also give and bequeath unto my said dearly beloved wife all my right title and interest in or arising from or that may hereafter arise from a certain contract or agreement which I made or entered into with the said Right Honourable the Lords of his Majesty's Treasury in the Month of May past for supplying the garrison of this Island and Jersey with provisions with full power and authority to service he half yearly and all other allowances for the keeping up said contract together with the provisions that may be or remain in store at the end or expiration of the said contract or agreement for her own use and benefit except only such part of the said contract relative to the Island of Jersey as I have made or assigned over my brother William BUDD by an instrument in writing bearing the date the 6th day of June 1778 which said assignment I confirm.
And do hereby give unto my said wife the same reserve or facility of revoking or setting aside the said assignment as I myself have that is to say in event? the said William BUDD his executors administrators or assigns or any of them shall at any time or times serving the continuance of the said contract make default in the duty and ? supplying the said garrison of the said Island of Jersey with such quantities and qualities of provisions as one mentioned and expressed in the contract or in any manner in the performance of the said William BUDD agreements comprised in the said contract that then and from thenceforth from and immediately after any such default shall be made under the said instrument or agreement with my said brother and every matter clause covenant and agreement therein contained shall be absolutely null and void to all interests and purposes whatsoever and it shall and may be lawful to and for my said dearly beloved wife Mary from and immediately after such default shall be made as aforesaid to supply the said garrison of Jersey with the said specified articles of provisions on her own account and to receive and take the money which shall
from or thereforth rise or accrue due to the same to and for her own use and
benefit during the continuance of the said contract or during the term of her
natural live and in case my said dear wife should not happen to survive me or
that she should die before the expiration of the said contract in either case I
do give and bequeath the whole to my dear sister Elizabeth BUDD and do
appoint her sole executor of this my last Will and if my said sister should not
survive my said wife or should die before the expiration of the said contract I
do then and in such case give and bequeath the whole of my real and personal
estate together with all the profits that may arise from the said contract to Stephen
TURNER of Fordingbridge in the County of Southampton [Hampshire or Hants]
and to Nicholas RESERSON of this Island of Guernsey Esq. in Trust for my
? and ? to be by them or the survivors of them shared and divided among my said
relations and ? from time to time share and share alike that is to say so many
of them as may in themselves if of age or by their parents or guardians if in
their
if in their annuity set up or make their respective claims within 12 calendar
months after my decease. I do also recommend to my said dear wife my said sister
Elizabeth BUDD particularly during her life time hoping she will support her
and at her decease leave what she may possess to ? and to my nephews and nieces
nether the less. I do not have intention this is a compulsive clause in this
Will but simply and solely as a request wishing that my dear wife may after my
decease have process and enjoy all my personal estate and effects together with
the profits and endowments arising from the treasury contract as is more fully
described in the beginning of this my will and Testament without being subject
or liable to be molested or accountable to any person whatsoever.
In witness whereof I have set my hand and seal to this my said last will and testament wrote with my own hand on five sheets of paper at Guernsey whose stamps are not in use the 17th day of January in the 20th year of the reign of our sovereign Lord George the Third and in the year of our Lord 1779. This Will was proved at London on the 17th October 1782 before the worshipful Andrew Coltee DUCALES Doctor of Laws Surrogate of the Right Worshipful Peter CALVERT Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oath Mary BUDD widow the relict of the deceased and sole executrix named in the said will to whom Administration was granted of all and singular the goods chattels and credits of the said deceased she having been first sworn to administer.
