Will of William BUDD (1731-1784)

In the name of God Amen. I William BUDD of the Island Guernsey Gentleman do make this my last will and testament in manner and form following. That is to say first and principally I command my soul to Almighty God my body I commit to the Earth to be decently buried at the direction of my executrix hereafter appointed and as to the worldly estate I am possessed I dispose therefore as follows.

I give to my dearly beloved wife Mary BUDD all my household goods plate linen china and in and every implements of household furniture whatsoever.

To hold the same to my said Wife for and during the term of her natural life and from and immediately after her decease I give the same to Nicholas DOBREE Senior of the said island of Guernsey Esquire his executors administrators or assigns upon trust that he do as soon as conveniently may be after my Wife's decease sale or cause to be sold all the said household goods plate linen china and other implements of household furniture by public auction or private contract. Which he that he may think the most advantageous and apply the monies arising from such sale towards the maintenance and education? of all my children shall be living at the time of the decease of my said Wife equally to be divided between them share and share alike till they respectively attain their ages of twenty one years. And whereas in and by two several appointments granted to me from the Right Honourable the Lords Commissioner of His Majesty's Treasury for laying up additional provisions in the Garrisons of Jersey bearing date the day of June 1778 and the second day March 1779. I stand possessed thereof to me and my assigns (During his Majesty's free will and pleasure and by virtue of such appointment considerable sums of money annually issues and arises to me there from and being desirous of making a further provision for my said Wife and children. I do in the first place give and bequeath to my said Wife the clear annum sum of three hundred pounds free from all manner of deductions and payments whatsoever to be paid to her or a sufficient authority in writing from her first had obtained for that purpose  by half yearly payments and the residue of the money arising from and under the said two several appointments after payment of the said sum of three hundred pounds a year to my said wife I give the same to the said Nicholas DOBREE his executors administrators or assigns  upon this further trust that he also apply the same to amongst all my said Children by my said Wife living at the time of my decease towards their support and maintenance till he she or they respectively attain the age of twenty one years. Then the residue to be divided between them share and share alike and in case of the death of either my said children then I will that the share of him or her so dying shall to the survivor or survivors of my Children in equal shares and proportions.

And I give and bequeath to my said Wife and children all and every such sum and sums of money securities for Money, Money in the funds or otherwise which I may be possessed of to be equally divided between them share and share alike that is to say the part or share or parts or shares of my children. In trust as before mentioned. And I do appoint the absolute care management and bring up of my said children to my wife and Nicholas DOBREE till they attain age of twenty one years.

And I do nominate constitute and appoint my said wife Executrix and the said Nicholas DOBREE trustee and executor with my said wife of this my last will and testament. In testimony whereof I the said William BUDD have to this my last Will and Testament set my hand to the foregoing sheet of paper and to the this my last sheet of paper my hand and seal this 13th day of December 1779. CODICIL. Since the signing the above will I do now nominate and appoint my son William BUDD Lieutenant of Marines to be in Trust with his Mother Mary BUDD instead of Nicholas DOBREE Esq. of the Island of Guernsey as above mentioned in my last Will and Testament. This Will was proved at London with a Codicil he 28th day July in the year of our Lord 1784 before the Right Honourable Peter CALVERT Doctor of Laws Master Keeper or Commissioner of the Prerogative Court of Canterbury lawfully constituted by the oath of MARY BUDD Widow the relict of the deceased and executrix named in the will to whom administration of all and singular the goods chattels and credits of the said deceased was granted she having been first sworn by the commission only to administer power reserved of making the like grant to William BUDD the son of the deceased and executor named in the said codicil when he shall apply for the same.
